Client Terms & Conditions

The Platform enables you to connect with a licensed therapist (LPC, LCSW, LMFT, EdD/PsyD, PhD), Certified Christian counselor, or Chaplain, consultant, practitioner, professional, coach or advisor (collectively “Counselor”) who will provide services to you through the Platform (collectively “Counselor Services”).

The Counselors are independent providers who are neither our employees nor agents nor representatives. Furthermore, we assume no responsibility for any act, omission or doing of any Counselor. The Platform’s role is limited to enabling the Counselor Services while the Counselor Services themselves are the responsibility of the Counselor who provides them. If you feel the Counselor Services provided by the Counselor do not fit your needs or expectations, you may change to a different Counselor who provides services through the Platform. If a Counselor you have been connected with stops using the Platform at any time after you have been connected, we will send an email to notify you that your Counselor is no longer on the Platform and that you have the opportunity to match with a new Counselor.

Christian Therapist on Demand does not practice medicine or any other licensed profession, and does not interfere with the practice of medicine or any other licensed profession by Counselors, each of whom is responsible for his or her services and compliance with the requirements applicable to his or her profession and license. Neither Christian Therapist on Demand nor any third parties who promote the Services or provide you with a link to the Service shall be liable for any professional advice you obtain from a Counselor via the Services.

Teletherapy is the delivery of health care services using interactive audio and video technology, where you and the counselor are not in the same physical location. During your teletherapy consultation with a Counselor, details of your health history, psychiatric history and personal health information may be discussed with you through the use of interactive video, audio and other telecommunications technology, and your Counselor will perform Counseling Services through these technologies.

The Counseling Services you receive from Counselors may not be intended to replace a primary face to face therapy modality. You should seek emergency help or follow-up care when recommended by a Counselor or when otherwise needed, and continue to consult with your primary face to face therapist and other healthcare professionals as recommended.

However, as with any Counseling Service, there are potential risks associated with the use of teletherapy. These risks include, but may not be limited to:

In rare cases, information transmitted may not be sufficient to allow for appropriate decision making by the Counselor;

Delays in evaluation or services could occur due to failures of the electronic equipment.

In rare cases, a lack of access to all of your health records may result in other judgment errors;
Although the electronic systems we use will incorporate network and software security protocols to protect the privacy and security of health information, in rare instances, security protocols could fail, causing a breach of privacy of personal health information.

By accepting these Terms of Use, you acknowledge that you understand and agree with the following:
You understand that you may expect the anticipated benefits from the use of teletherapy in your care, but that no results can be guaranteed or assured.

You understand that the laws that protect the privacy and security of health information apply to teletherapy and have received Christian Therapist On Demand’s Notice of Privacy Practices, which describes these protections in more detail. Electronic communications are directed to your Counselor(s) through a secure, encrypted video, audio and / or text communication interface and electronic record.

With respect to Counseling, you are entitled to receive information from your Counselor about the methods of therapy, the techniques used, the duration of your therapy (if known), and the fee structure. You can seek a second opinion from another therapist or terminate therapy at any time.  With respect to Counseling, if you and your Counselor decide to engage in group or couples therapy (collectively “Group Therapy”), you understand that information discussed in Group Therapy is for therapeutic purposes and is not intended for use in any legal proceedings involving Group Therapy participants. You agree not to subpoena the Treating Provider to testify for or against other Group Therapy participants or provide records in court actions against other Group Therapy participants.

You understand that anything any Group Therapy participant tells the Counselor individually, whether on the phone or otherwise, may at the therapist’s discretion be shared with the other Counselor participants. You agree to share responsibility with the Counselor for the therapy process, including goal setting and termination.

You can send messages to your Treating Provider through the Christian Therapist On Demand platform. Or if you have further questions contact Customer Support at 1-888-35THERAPY (1-888-358-4372). Voicemails, Emails or electronic messages to Customer Support or your Counselor may not be returned immediately.

If you are experiencing a psychiatric emergency, you should call 911 or go to the nearest emergency room.

You may also send help inquiries or technical support requests through the platform or to Customer Support at support@christiantherapistod.com.

Messages you send over the Platform may be viewed by more than one Counselor or Customer Support agent and will typically be answered within 24 hours.

You understand and agree that messaging with Counselor over the Platform does not give rise to a provider-patient relationship, and does not by itself constitute treatment, diagnosis, therapy, counseling, or medical advice.

 

While we hope the Counselor Services are beneficial to you, you understand, agree and acknowledge that they may not be the appropriate solution for everyone’s needs and that they may not be appropriate for every particular situation and/or may not be a complete substitute for a face-to-face examination and/or care in every particular situation.

Geographical Restrictions. Christian Therapist On Demand makes no representation that all products, services and/or material described on the Platform, or the Services available through the Platform, are appropriate or available for use in all states within the United States or locations outside the United States or all territories within the United States.

IF YOU ARE THINKING ABOUT SUICIDE OR IF YOU ARE CONSIDERING HARMING YOURSELF OR OTHERS OR IF YOU FEEL THAT ANY OTHER PERSON MAY BE IN ANY DANGER OR IF YOU HAVE ANY MEDICAL EMERGENCY, YOU MUST IMMEDIATELY CALL THE EMERGENCY SERVICE NUMBER (911 IN THE US and 999 in the UK) AND NOTIFY THE RELEVANT AUTHORITIES. SEEK IMMEDIATE IN PERSON ASSISTANCE. THE PLATFORM IS NOT DESIGNED FOR USE IN ANY OF THE AFOREMENTIONED CASES AND THE COUNSELORS CANNOT PROVIDE THE ASSISTANCE REQUIRED IN ANY OF THE AFOREMENTIONED CASES.

THE PLATFORM IS NOT INTENDED FOR THE PROVISION OF CLINICAL DIAGNOSIS REQUIRING AN IN-PERSON EVALUATION AND YOU SHOULD NOT USE IT IF YOU NEED ANY OFFICIAL DOCUMENTATION OR APPROVALS FOR PURPOSES SUCH AS, BUT NOT LIMITED TO, COURT-ORDERED COUNSELING OR EMOTIONAL SERVICE DOG CERTIFICATION. IT IS ALSO NOT INTENDED FOR ANY INFORMATION REGARDING WHICH DRUGS OR MEDICAL TREATMENT MAY BE APPROPRIATE FOR YOU, AND YOU SHOULD DISREGARD ANY SUCH ADVICE IF DELIVERED THROUGH THE PLATFORM.

DO NOT DISREGARD, AVOID, OR DELAY IN OBTAINING IN-PERSON CARE FROM YOUR DOCTOR OR OTHER QUALIFIED PROFESSIONAL BECAUSE OF INFORMATION OR ADVICE YOU RECEIVED THROUGH THE PLATFORM.

You are advised to exercise a high level of care and caution in the use of the Platform and the Counselor services.

Platform Content:

None of the Platform content (other than information you receive from a Counselor) should be considered advice or an endorsement, representation or warranty that any treatment is safe, appropriate, or effective for you. Including resources available through the platform, designed to aid you in your conversation with your counselor.

Christian Therapist On Demand make no representation or warranty whatsoever as to the willingness or ability of a Counselor to give advice.

Christian Therapist On Demand make no representation or warranty whatsoever as to whether you will find the Counselor Services relevant, useful, correct, satisfactory, or suitable to your needs.

We do not control the quality of the Counselor Services and we do not determine whether any Counselor is qualified to provide any specific service as well as whether a Counselor is categorized correctly or matched correctly to you.

While we may try to do so from time to time, in our sole discretion, you acknowledge that we do not represent to verify, and do not guarantee the verification of, the skills, degrees, qualifications, licensure, certification, credentials, competence or background of any Counselor. It is your responsibility to conduct independent verification regarding any Counselor that provides you with Counselor Services (whether through the Platform or not) and we strongly recommend that you will conduct this verification prior to communicating with any Counselor through the Platform and on a continuous basis as you use the Platform.
Your relationship relating to the Counselor Services is strictly with the Counselor. We are not involved in any way with the actual substance of that relationship or any part of the Counselor Service (whether provided through the Platform or not), and we do not validate or get involved in any of the Counselor Services.

In case you make a payment through the Platform, or make any payment to us, this payment is made to the Counselor for the Counselor Services. We may charge the counselor by taking a portion of this payment for the use and operation of the Platform (“Platform Use Fees”). However, we will not be deemed as the counselor of any Counselor Services regardless of payment. Furthermore, the payment for the use of the Platform is made by the Counselor and not by you.

Third Party Content:

The Platform may contain other content, products or services which are offered or provided by third parties (“Third Party Content”), links to Third Party Content (including but not limited to links to other websites) or advertisements which are related to Third Party Content. You confirm and acknowledge that we have no responsibility over any such Third Party Content, including (but not limited to) any related products, practices, terms or policies, and that we will not be liable for any damage or loss caused by any Third Party Content.

YOU HEREBY RELEASE US AND AGREE TO HOLD US HARMLESS FROM ANY AND ALL CAUSES OF ACTION AND CLAIMS OF ANY NATURE RESULTING FROM THE COUNSELOR SERVICES OR THE PLATFORM, INCLUDING (WITHOUT LIMITATION) ANY ACT, OMISSION, OPINION, RESPONSE, ADVICE, SUGGESTION, INFORMATION AND/OR SERVICE OF ANY COUNSELOR AND/OR ANY OTHER CONTENT OR INFORMATION ACCESSIBLE THROUGH THE PLATFORM.

YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT THE PLATFORM IS PROVIDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, NON-INFRINGEMENT, SECURITY, FITNESS FOR A PARTICULAR PURPOSE OR ACCURACY. THE USE OF THE PLATFORM IS AT YOUR OWN RISK. TO THE FULLEST EXTENT OF THE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED.

YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT WE SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES.

YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT OUR AGGREGATE LIABILITY FOR DAMAGES ARISING WITH RESPECT TO THIS AGREEMENT AND ANY AND ALL USE OF THE PLATFORM WILL NOT EXCEED THE TOTAL AMOUNT OF MONEY PAID BY YOU OR ON YOUR BEHALF THROUGH THE PLATFORM IN THE 12 MONTHS PERIOD PRIOR TO THE DATE OF THE CLAIM.

LIMITATION OF LIABILITY. YOU UNDERSTAND THAT TO THE EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT WILL CHRISTIAN THERAPIST ON DEMAND OR ITS OFFICERS, EMPLOYEES, DIRECTORS, PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF REVENUES, PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE/APP/APP OR THE SERVICES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), WARRANTY, STATUTE OR OTHERWISE. To the extent that we may not, as a matter of applicable law, disclaim any implied warranty or limit its liabilities, the scope and duration of such warranty and the extent of our liability will be the minimum permitted under such applicable law.

If the applicable law does not allow the limitation of liability as set forth above, the limitation will be deemed modified solely to the extent necessary to comply with applicable law.

This section (limitation of liability) shall survive the termination or expiration of this Agreement.

You hereby confirm that you are at least 18 years old of age.
You hereby confirm that you are legally able to enter into a contract and give consent.

You hereby confirm and agree that all the information that you provided in or through the Platform, and the information that you will provide in or through the Platform in the future, is accurate, true, current and complete. Furthermore, you agree that during the term of this Agreement you will make sure to maintain and update this information so it will continue to be accurate, current and complete.

When you register on the Platform you are required to create an account (“Account”) by entering your name, email address, password and certain other information collected by Christian Therapist On Demand (collectively “Account Information”). To create an Account, you must be of legal age to form a binding contract. If you are not of legal age to form a binding contract, you may not register to use our Services. You agree that the Account Information that you provide to us at all times, including during registration and in any information you upload to the Platform will be true, accurate, current, and complete.

Use of the Services by Children. The Services are available for use by adolescents (13-17), but the Account for all patients under the age of 18 must be the registered patient’s parent or legal guardian and legally able to consent to Counselor services on behalf of the adolescent. If you register as the parent or legal guardian on behalf of a minor, you will be fully responsible for complying with these Terms of Use as is the minor.

You may not transfer or share your Account password with anyone, or create more than one Account (with the exception of subaccounts established for children of whom you are the parent or legal guardian). You are responsible for maintaining the confidentiality of your Account password and for all activities that occur under your Account. Christian Therapist On Demand reserves the right to take any and all action, as it deems necessary or reasonable, regarding the security of the Platform and your Account Information. In no event and under no circumstances shall Christian Therapist On Demand be held liable to you for any liabilities or damages resulting from or arising out of your use of the Christian Therapist On Demand Platform, your use of the Account Information or your release of the Account Information to a third party. You may not use anyone else’s account at any time.

You agree to notify us immediately of any unauthorized use of your Account Access or any other concern for breach of your account security.

You agree, confirm and acknowledge that we will not be liable for any loss or damage that incurred as a result of someone else using your account, either with or without your consent and/or knowledge.

You agree, confirm and acknowledge that you are solely and fully liable and responsible for all activities that are made by using your Account Access. You further acknowledge and agree that we will hold you liable and responsible for any damage or loss incurred as a result of the use of your Account Access by any person whether authorized by you or not, and you agree to indemnify us for any such damage or loss.

You agree and confirm that your use of the Platform, including the Counselor Services, are for your own personal use only and that you are not using neither the Platform nor the Counselor Services for or behalf of any other person or organization.
You agree and commit not to interfere with or disrupt, or attempt to interfere with or disrupt, any of our systems, services, servers, networks or infrastructure, or any of the Platform’s systems, services, servers, networks or infrastructure, including without limitation obtaining unauthorized access to the aforementioned.

You agree and commit not to make any use of the Platform for the posting, sending or delivering of either of the following: (a) unsolicited email and/or advertisement or promotion of goods and services; (b) malicious software or code; (c) unlawful, harassing, privacy invading, abusive, threatening, vulgar, obscene, racist or potentially harmful content; (d) any content that infringes a third party right or intellectual property; (e) any content that may cause damage to a third party; (f) any content which may constitute, cause or encourage a criminal action or violate any applicable law.

You agree and commit not to violate any applicable local, state, national or international law, statute, ordinance, rule, regulation or ethical code in relation to your use of the Platform and your relationship with the Counselors and us.
If you receive any file from us or from a Counselor, whether through the Platform or0 not, you agree to check and scan this file for any virus or malicious software prior to opening or using this file.

You will indemnify us, defend us, and hold us harmless from and against any and all claims, losses, causes of action, demands, liabilities, costs or expenses (including, but not limited to, litigation and reasonable attorneys’ fees and expenses) arising out of or relating to any of the following: (a) your access to or use of the Platform; (b) any actions made with your account or Account Access whether by you or by someone else; (c) your violation of any of the provisions of this Agreement; (d) non-payment for any of the services (including Counselor Services) which were provided through the Platform; (e) your violation of any third party right, including ,without limitation, any intellectual property right, publicity, confidentiality, property or privacy right. This clause shall survive expiration or termination of this Agreement.

 

You agree to pay all fees or charges to your Account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. By providing Christian Therapist On Demand with your credit card number or PayPal account and associated payment information, you agree that Christian Therapist On Demand is authorized to immediately invoice your account for all fees and charges due and payable to Christian Therapist On Demand hereunder and that no additional notice or consent is required. If another agency has arranged with Christian Therapist On Demand to pay the fee or any portion of the fee, or if the fee is pursuant to some other arrangement with Christian Therapist On Demand, that fee adjustment will be reflected in the fee that you are ultimately charged.

You confirm and agree that all payment related information that you provided and will provide in the future, to or through the Platform, are accurate, current and correct and will continue to be accurate, current, and correct.

You confirm and agree to use only payment means (credit cards or others) which you are dully and fully authorized to use.
You agree that all current and future interactions (whether online or offline) between you and a Counselor will be made, managed, and billed through Platform.

If, for any reason, an interaction between you and the Counselor is not made through the Platform, you agree that it will be billed through the platform and that the standard Platform Use Fees will be charged and delivered to us even if the Platform hasn’t been used for this interaction.

You agree and commit to immediately notify us, including all the relevant details, in any case that you receive a service from a Counselor not through the Platform or in any case that you are billed by a Counselor not through the Platform.

You agree to pay all fees and charges associated with your Account on a timely basis and according to the fees schedule, the terms and the rates as published in the Platform. Including but not limited, to payment of services following a free trial. Understanding that there may not be an additional notice of charges following the expiration of the free trial. Such fees and charges (including any taxes and late fees, as applicable) will be charged to your credit card. By providing us with your credit card information you authorize us to bill and charge you through that credit card. You agree to maintain valid credit card information in your Account information.

You agree that your credit card information and related personal data may be provided to third parties for payment processing and fraud prevention purposes. We may suspend or terminate your Services if at any time we determine that your payment information is inaccurate or not current, and you are responsible for fees and overdraft charges that we may incur when we charge your card for payment.

You may submit your invoices to your insurance carrier for a request of reimbursement for therapeutic services. Please check with your employer, health plan or agency to determine if any Services will be reimbursed. Christian Therapist On Demand offers no guarantee that you shall receive any such reimbursement. Christian Therapist On Demand reserves the right to modify or implement a new pricing structure at any time prior to billing you for your initial payment or for future payments due pursuant to these Terms of Use. We will notify you of any price changes by publishing on our website, emailing, quoting or invoicing you.

You understand and agree that for Services provided on an appointment basis, you will be responsible for missed appointments, and no credit or “make up” sessions will be given for missed appointments if you do not cancel a scheduled appointment at least 48 hours in advance.

Your initial subscription term will be specified in your Order, or if no term is specified, your Initial Term will be effective on the first day that your credit card is charged. Your subscription will automatically renew each month (“Renewal Terms”), unless either party provides notice of non-renewal.

You may cancel your subscription at any time, for any reason through the platform or by sending an email to terminations@christiantherapistOD.com. Christian Therapist On Demand will immediately terminate your use of the Platform. Subject to applicable law, Christian Therapist On Demand reserves the right to maintain, delete or destroy all communications and materials posted or uploaded to the Platform pursuant to its internal record retention and/or content destruction policies. After such termination, Christian Therapist On Demand will have no further obligation to provide the Services, except to the extent we are obligated to provide you access to your health records or Treating Providers are required to provide you with continuing care under their applicable legal, ethical, and professional obligations to you.
If the Agreement or any Services are terminated, you will immediately discontinue all access and use of the terminated Services. Neither party will be liable for any damages resulting from termination of the Agreement, nor will termination affect any claim arising prior to the effective termination date. You agree to pay for any use of the Services past the date of expiration or termination.

 

If you have any concerns about a bill or a payment, please contact us immediately by sending an email to support@christiantherapistod.com We will evaluate your issue on a case by case basis and, at our discretion, take steps to resolve any issue, including but not limited to helping you find a new Counselor, extending your subscription at no cost to you, and issuing partial or full refunds when applicable.

In case you make a payment through the Platform, or make any payment to us, this payment is made to the Counselor for the Counselor Services. We may charge the counselor by taking a portion of this payment for the use and operation of the Platform (“Platform Use Fees”). However, we will not be deemed as the counselor of any Counselor Services regardless of payment. Furthermore, the payment for the use of the Platform is made by the Counselor and not by you.

Christian Therapist On Demand offers a free three day of basic chat service for new customers for the Unlimited Messaging Plan and the Ultimate Unlimited Messaging Plan only.*  Sign up for your trial offer and instantly access the entire Christian Therapist On Demand resources and gain access to a licensed professional Christian counselor.
You won’t be charged during your free trial, and you can cancel at any time through the platform. If you choose to continue enjoying the benefits of Christian Therapist On Demand after your trial ends, you’ll be automatically charged the full monthly fee.

We ask for a payment method to ensure you don’t have any interruption in service after the free trial. We do this by sending an authorization request to your financial institution to verify that your payment method works. These requests are not charges, but in some cases they may temporarily affect your available account balance. You will not be charged if you do not continue our service.

You understand, agree and acknowledge that we may modify, suspend, disrupt or discontinue the Platform, any part of the Platform or the use of the Platform, whether to all clients or to you specifically, at any time with or without notice to you. You agree and acknowledge that we will not be liable for any of the aforementioned actions or for any losses or damages that are caused by any of the aforementioned actions.

The Platform depends on various factors such as software, hardware and tools, either our own or those owned and/or operated by our contractors and suppliers. While we make commercially reasonable efforts to ensure the Platform’s reliability and accessibility, you understand and agree that no platform can be 100% reliable and accessible and so we cannot guarantee that access to the Platform will be uninterrupted or that it will be accessible, consistent, timely or error-free at all times.

The Platform and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by the Company, its licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. These Terms of Use permit you to use the Platform for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our Platform except as generally and ordinarily permitted through the Platform according to these Terms of Use. You must not access or use for any commercial purposes any part of the Platform or any services or materials available through the Platform.

Certain of the names, logos, and other materials displayed on the Platform or in the Services may constitute trademarks, trade names, service marks or logos (“Marks”) of Christian Therapist On Demand or other entities. Including, “You Can Have Jesus and a Therapist Too.” You are not authorized to use any such Marks without the express written permission of Christian Therapist On Demand. Ownership of all such Marks and the goodwill associated therewith remains with us or those other entities.

The Counselors hold certifications in Christian counseling, professional licenses issued by the professional licensing boards in the states where they practice, hold counseling degrees in either psychology, social work, marriage and family therapy, counseling and or specialized training. You can report a complaint relating to services provided by a Treating Provider by contacting the professional licensing board in the state where the services were received. You can report a complain relating to services provided by a Certified Christian counselor by contacting the agency where the counselor has received certification. In a professional relationship, sexual intimacy is never appropriate and should be reported to the board that licenses, registers, or certifies the licensee / Counselor.

These Terms of Use and your use of the Platform shall be governed by the laws of the State of California, without giving effect to the principles of conflict of laws.

You irrevocably agree that the exclusive venue for any action or proceeding arising out of relating to this Agreement or our relationship with you, regardless of theory, shall be the U.S. District Court for the Northern District of California, or the state courts located in Fresno County in California. You irrevocably consent to the personal jurisdiction of the aforementioned courts and hereby waive any objection to the exercise of jurisdiction by the aforementioned courts.

THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN YOU AND US. YOU CONFIRM THAT YOU HAVE NOT RELIED UPON ANY PROMISES OR REPRESENTATIONS BY US EXCEPT AS SET FORTH IN THIS AGREEMENT.
We may change this Agreement by posting modifications on the Platform. Unless otherwise specified by us, all modifications shall be effective upon posting. Therefore, you are encouraged to check the terms of this Agreement frequently. The last update date of this Agreement is posted at the bottom of the Agreement. By using the Platform after the changes become effective, you agree to be bound by such changes to the Agreement. If you do not agree to the changes, you must terminate access to the Platform and participation in its services.
We may freely transfer or assign this Agreement or any of its obligations hereunder.

You understand that by checking the “agree” box for these Terms of Use and/or any other forms presented to you on the Platform you are agreeing to these Terms of Use and that such action constitutes a legal signature.
